1. Ownership of the website

The website agentautoma.com (the “Site”) is owned by Antonio Di Marzio, owner of the sole proprietorship trading under the brand AgentAutoma, with registered office at Via Val di Foro 140, 66010 Casacanditella (CH), VAT No. IT 02878780697, Tax Code DMRNTN82D10C632S (“AgentAutoma”).

These terms govern access to and use of the Site. Browsing the Site constitutes acceptance of these terms; anyone who does not accept them is asked not to use it.

2. Purpose and nature of the content

The Site serves to inform about and promote the consultancy, software development, systems integration and process automation services offered by AgentAutoma, and the applications it has developed.

Blog articles, descriptions of services and products and the examples published are informative and general in nature: they do not constitute personalised professional, technical, legal or tax advice, nor a contractual offer within the meaning of Art. 1336 of the Italian Civil Code. No content should be used as the sole basis for business decisions without an assessment of the specific case.

3. Professional services and applications

AgentAutoma's services are aimed at businesses and professionals. Prices, timescales or results stated on the Site are indicative and not binding: each engagement is governed exclusively by the accepted offer or by the contract signed between the parties, which prevail over these terms. Where an engagement involves processing personal data on behalf of the client, the parties sign a data processing agreement pursuant to Art. 28 GDPR, annexed to the contract.

The applications offered on a subscription basis (HACCP DettoFatto and Agens) are governed by their respective Terms of Service, Privacy Notice and Data Processing Agreement, published on the website of each application.

4. Intellectual property

All content on the Site (texts, graphics, layout, trade marks, logos, the name “AgentAutoma”, images, illustrations and source code) belongs to AgentAutoma or to the respective owners and is protected by copyright law (Law 633/1941), the Industrial Property Code (Legislative Decree 30/2005) and international rules.

Any exploitation, in whole or in part (reproduction, copying, modification, distribution, publication, sale), without the written consent of AgentAutoma is prohibited. It is permitted to:

  • consult and print the content for personal, non-commercial use, retaining the attribution notices;
  • quote short extracts for criticism, discussion or teaching, citing the source with a link to the original page.

Third-party trade marks mentioned (for example Vercel, N8N, Supabase) belong to their respective owners and are used for descriptive purposes only, without any sponsorship or affiliation relationship except where stated.

5. Use of the Site and the contact form

Users shall use the Site in compliance with the law, good faith and these terms. In particular, it is prohibited to:

  • use the Site for unlawful or fraudulent purposes or purposes that infringe the rights of others;
  • alter, damage or compromise the Site or the systems hosting it, or attempt to access them without authorisation;
  • introduce viruses, malware or malicious code;
  • systematically extract content (scraping, data mining, mass collection) without written authorisation, including for training artificial intelligence systems;
  • send via the contact form unsolicited advertising, automated submissions or defamatory, obscene, discriminatory content or content contrary to public order;
  • enter in the form personal data of third parties without being entitled to do so, or confidential and private information.

AgentAutoma may block access to the Site and take action before the competent bodies against anyone who breaches these terms.

6. Limitation of liability

AgentAutoma takes care in drafting and updating the content, but does not guarantee that it is always complete, accurate, up to date or fit for a specific purpose.

To the extent permitted by law, AgentAutoma is not liable for:

  • direct or indirect damage arising from access to, use of or inability to use the Site and its content;
  • interruptions, malfunctions, delays or unavailability of the Site or the contact form, including due to maintenance, force majeure or acts of third parties, including hosting and e-mail providers;
  • damage caused by viruses or harmful elements to the user's devices as a result of access;
  • decisions taken by the user on the basis of the informative content.

This is without prejudice to liability for wilful misconduct or gross negligence and to the mandatory rights of consumers.

Links to third-party websites are provided as a courtesy for information purposes. AgentAutoma does not control those websites and is not responsible for the content, services, terms or data processing found there.

Links to the Site from third parties are permitted provided they are accurate and fair, do not damage AgentAutoma's reputation and do not suggest non-existent associations or sponsorships. Framing the Site or parts of it (frame) or using similar structures is prohibited.

8. Processing of personal data

The processing of users' data is described in the Privacy notice and the Cookie policy, which form an integral part of these terms.

9. Changes

AgentAutoma may amend these terms at any time, including as a result of changes in legislation or in the services. Changes take effect from publication on this page, with the date of the last update. Continuing to use the Site constitutes acceptance of the version in force.

10. Governing law and jurisdiction

These terms are governed by Italian law. The Court of Chieti shall have exclusive jurisdiction over any dispute concerning their interpretation, performance or validity, without prejudice to the mandatory jurisdiction of the consumer's court (Art. 66-bis Consumer Code (Legislative Decree 206/2005)), where applicable.

11. Language

The Site is available in Italian, English and Spanish. The English and Spanish versions of the legal texts are courtesy translations: in the event of any discrepancy, the Italian text prevails.

13. Final provisions

Matters not provided for herein are governed by the provisions of law. The invalidity of any clause shall not affect the validity of the others.
